在澳洲，没有遗嘱去世会发生什么？+
维州《遗产管理及继承法》规定了"无遗嘱继承"（intestacy）的法定顺序：通常先由配偶继承，子女、父母再按比例。但实际计算和登记十分复杂，且可能完全不符合您本人意愿（例如再婚配偶继承大部分而原生子女只分到一小份）。立一份遗嘱是避免这一切的最简单方式。

技术上可以，但风险非常大。维州《遗嘱法》（Wills Act 1997）要求遗嘱必须由立遗嘱人本人签署、两名独立见证人同时在场签名见证，且见证人不能是受益人或其配偶。许多 DIY 模板没有清楚指明这些要件，常见结果是遗嘱在遗嘱认证（Probate）阶段被法院拒绝。我们见过太多家庭事后花数万律师费来弥补几百块的省钱选择。
立遗嘱大概要多少钱？+

我在中国 / 香港有房产，能写进澳洲遗嘱里吗？+
原则上可以，但并不建议。境外不动产通常须依当地法律处理，写入澳洲遗嘱容易引发条款冲突或延误认证。更稳妥的做法，是为境外资产单独立遗嘱，并与澳洲遗嘱互不撤销、彼此对齐；马律师本人为注册国际公证律师，可协助海牙认证（Apostille）与中国公证程序对接。
再婚 / 离婚后，原来的遗嘱还有效吗？+
根据《遗嘱法》第 13 条，结婚通常会自动撤销之前的遗嘱（除非遗嘱本身是为该婚姻而立）；离婚则只会撤销遗嘱中对前配偶的指定，其他部分继续有效。这是华人客户最常踩的坑——再婚后忘记更新遗嘱，遗产意外流向新配偶或前配偶。
持久授权书（EPOA）与一般授权书（General POA）有什么区别？+
一般授权书在您"丧失决策能力"时自动失效；持久授权书（Enduring）反而专门设计为"在您丧失能力时仍然有效"。对于上了年纪、即将做大手术、长期出国或患有进行性疾病的客户，EPOA 才是真正能保护您的工具。
持久授权书可以代替医疗决策吗？+
不可以。维州自 2018 年起施行《医疗决策规划法》（Medical Treatment Planning and Decisions Act 2016），引入独立的"医疗决策人"（Medical Treatment Decision Maker, MTDM）文件。持久授权书处理财务和个人事务，MTDM 才能在医疗场景代您做手术、维生器械、临终照护等决定。AMA 通常建议两份一起签。
申请遗嘱认证（Probate）需要多久？+
从亲人去世到向维州最高法院（Supreme Court of Victoria）拿到遗嘱认证令（Grant of Probate），一般 6–12 周。若资产复杂（跨境、未注册公司股权、有人提出家庭供养申请等），可延长至 6 个月以上。
如果对遗嘱或遗产分配有异议，能怎么办？+
维州法律承认两类不同的请求——① 如果您认为遗嘱本身完全有效但分配不公（例如配偶 / 子女被忽略），可在亲人去世后 6 个月内提出家庭供养申请（Family Provision Claim），请求法院重新分配；② 如果您怀疑遗嘱本身的有效性（立遗嘱人能力不足、受不当影响、签署不合规等），那是 "遗嘱效力争议" 程序——两者法律依据、举证标准都不同。
