依据维州《遗嘱法》（Wills Act 1997），一份在维州有效的遗嘱必须同时满足以下 5 个法定条件。任何一条缺失，都可能在遗嘱认证阶段被拒绝。
01
年满 18 岁，且具备遗嘱能力（Testamentary Capacity）
立遗嘱人（Testator）需清楚理解自己的资产范围、继承人身份，以及遗嘱内容所产生的法律后果。
02
以书面形式签署
遗嘱必须以纸质文件呈现并本人签名；口头承诺、录音、微信语音均不构成有效遗嘱。
03
两名独立见证人同时在场，看着立遗嘱人签名
两位见证人必须年满 18 岁、意识清楚，并全程亲眼见证签署过程。
04
两名见证人当着立遗嘱人面，在同一份文件上签名
三人须在同一时间、同一地点连续签署，中途离开即视为无效。
05
见证人不能是受益人，也不能是受益人的配偶
若见证人本身或其配偶被列为受益人，其受益部分将被自动作废，风险极大。
风险提示：其中任何一条不到位，遗嘱都可能在遗嘱认证（Probate）阶段被维州最高法院拒绝认证，导致遗产按"无遗嘱继承"方式分配——这是 DIY 模板最常见的失败原因。

遗嘱要不要公证（Notarisation）？
在澳洲境内，一份合规签署的维州遗嘱不需要额外公证。但如果您在中国也有资产、希望遗嘱能在中国被承认，则可能需要办理海牙加签或使领馆认证——这部分我们可以协助安排。
我没结婚也没有孩子，需要立遗嘱吗？
同样需要。没有遗嘱的情况下，您的资产会按维州《行政法》（Administration and Probate Act）的默认继承顺序分配，可能与您真实意愿差距很大。宠物照顾、慈善捐赠、对朋友的遗赠——都需要通过遗嘱表达。
我在中国也有资产，需要在澳洲和中国分别立遗嘱吗？
建议 分别立遗嘱且互不撤销——澳洲遗嘱管辖澳洲境内资产，中国遗嘱管辖境内资产。两份遗嘱需精心措辞，避免相互冲突。这是华人客户最容易忽视的跨境规划环节，我们提供专门的双语衔接方案。
我能在遗嘱里指定宠物归谁照顾吗？
可以。您可以在遗嘱中指定宠物的照顾人（Pet Guardian），并同时留一笔资金用于日常开销和医疗费用。若资金较大，可通过遗嘱信托（Testamentary Trust）结构管理。
遗嘱原件丢了怎么办？
副本或扫描件不具备原件效力，遗嘱认证阶段可能被拒。我们建议原件由律师事务所保管，并将存放位置告知执行人与直系亲属。若原件确认遗失，需向维州最高法院申请"依据副本认证"，程序复杂且并非一定成功。
立遗嘱后，我以后还能修改吗？
当然可以。您可以随时通过 遗嘱附录（Codicil） 做小改动，或者 重新起草一份新遗嘱 并明确撤销所有旧版本。生活重大变化后建议 6 个月内重新审视，我们提供固定收费的修订/重立服务。
如果我没立遗嘱就去世，家人怎么继承？
依据维州《行政法》的默认继承顺序：配偶优先获得法定遗产份额（约 A$56 万起，每年调整），剩余部分再与子女分割。这种默认分配可能完全不符合您的家庭结构与真实意愿——尤其是再婚家庭、有未成年子女、或涉及跨境资产的情况。
立遗嘱需要多长时间？
简单单人遗嘱通常 2–4 周 完成：初步沟通、正式咨询与方案、起草与您确认、签署与见证。复杂家庭结构（再婚、遗嘱信托、跨境资产）可能需要 4–8 周。紧急情况下可加急处理。
