一般授权书（General POA）

TYPE 02
持久授权书（Enduring POA）
关键在「持久」：即使您日后失去决策能力仍然有效，可涵盖财务事项与个人事项。
TYPE 03
医疗决策人（MTDM）
专门就医疗决定：在您无法自行决定时，由您指定的人依您的意愿作出医疗决策。
AMA 的建议：通常建议同时订立「持久授权书 + 医疗决策人」，让财务、生活与医疗三方面都有值得信任的人替您做主，不留缺口。

授权书不是「老了才需要」——意外与疾病无法预约。以下情形，尤其建议尽早安排：

名下有房产、生意或投资
一旦您无法签字，账户、买卖、报税都可能卡住，家人也没有自动的代办权限。

经营小生意 / 是公司董事
您若临时无法决策，付款、合同、员工工资都可能停摆，生意经不起长时间空转。

计划或经常往返海外
人在境外，仍可让受权人在澳洲处理您的事务，避免两地来回奔波。
04
上了年纪，或有健康隐忧
趁头脑清晰时订立，是给自己、也是给家人的一份安心。

家庭成员分散，或再婚家庭
明确由谁做主，能减少日后的误会与纷争。
合 规 要 求
一份有效的持久授权书，须满足这些要件
签了名不等于有效。维州《持久授权书法》2014（Powers of Attorney Act 2014）对订立与见证有明确要求，任一环节出错都可能导致文件无效。

使用维州法定表格
持久授权书须以维州规定的法定表格订立，可涵盖财务事项与／或个人事项。

签署时具备决策能力
您在签署时须理解文件的性质与效果，并出于自愿。

须有两名见证人
须由两名成年见证人见证，其中一人须是有资格见证法定声明的人（或注册医生）。
4
见证人资格限制
您或受权人的亲属、受权人本人、您的照护者或住宿提供者，均不得担任见证人。
5
见证人签署证明
见证人须在文件上证明：您签署时看来具备决策能力、理解文件、并且是自愿签署。这是法定表格内置的见证证明，并非某种单独的「证书」。

受权人签署接受声明
您指定的受权人须签署接受声明，表明愿意承担相应的法律职责。
更省事：AMA 可在办公室为您完成合规见证，并同步办理医疗决策人（MTDM）的指定，一次安排到位。
常 见 误 区
常见误区，一般人都没想到
关于授权书，几个流传很广、却可能让家人措手不及的误解：
误区一
「有遗嘱就够了」
遗嘱只在您身后生效，完全不管您「生前失去决策能力」的那段时间。生前的财务与医疗决定，要靠持久授权书与医疗决策人，遗嘱替代不了。
误区二
「家人自然可以替我做主」
在财务与个人事务上，家人并没有自动的代理权，往往要向 VCAT（维州民事与行政仲裁庭）申请才能管理；医疗方面虽有默认的亲属顺序，但未必是您最想指定的那个人。
误区三
「我在中国／海外做的授权书，在澳洲一样有效」
不一定。澳洲不会自动承认境外授权书；要在维州稳妥处理房产与财务，通常需要另立一份符合维州法律的持久授权书。若涉及境外文件，建议先咨询确认。
误区四
「等需要时再办也不迟」
恰恰相反：一旦您失去决策能力，就无法再订立授权书；家人只能向 VCAT 申请财产管理人与监护人——费时费力，且未必是您属意的人选。趁能做主时安排，才能掌握主动权。

可以指定一位或多位受权人。多位时可以约定「共同」（jointly，须一致同意）、「共同及各别」（jointly and severally，可各自单独行事），或按多数决——具体怎么设，取决于您的情况，我们会帮您理清利弊。
受权人可以随便动用我的钱吗？
不可以。受权人负有法律上的谨慎与忠实义务（fiduciary duty）：须诚实、尽责、避免利益冲突、妥善记账，并以您的最佳利益行事。若有滥用，VCAT 可介入追究并要求赔偿。
持久授权书什么时候开始生效？
财务事项可以约定「立即生效」，或「在您失去决策能力时才生效」；个人与医疗方面，通常在您无法自行决定时，才由受权人／医疗决策人行使。怎么设由您决定。
如果我没有订立，会怎样？
一旦失去决策能力，家人须向 VCAT 申请，由其指定财产管理人（administrator）与监护人（guardian）。这意味着由法庭、而不是由您，来决定谁替您做主——过程也更费时。
