认 证 流 程
Apostille 与国际公证：四步完成跨境文件认证
Apostille（海牙认证）是让一国出具的公文，在其他海牙公约成员国之间获得承认的简化认证。澳洲与中国大陆均为海牙公约成员国（中国大陆于 2023 年 11 月正式加入）。香港与澳门作为特别行政区，其海牙认证安排须另行确认，不自动适用中国大陆的成员资格；如涉及港澳文件，请在咨询时告知 AMA 以确认适用程序。

这是跨境遗产规划中最关键、也最容易被忽视的一环。安排得当，能让两地资产各得其所；安排不当，一份遗嘱可能拖慢甚至冲销另一地的继承。

为什么"一份澳洲遗嘱写上所有资产"往往不够
境外资产（如中国大陆房产）通常须依当地法律与程序处理，澳洲遗嘱在当地未必被直接承认；而若在澳洲遗嘱中写入境外资产，又可能与当地继承规则冲突，甚至拖慢两地的认证程序。

关于跨境遗产与国际公证的 5 个常见问题
中国的遗嘱在澳洲有效吗？澳洲的遗嘱在中国有效吗？
各法域对遗嘱的形式与执行要求不同。中国大陆于 2023 年 11 月加入海牙公约，跨境文件的认证因此简化，但一份遗嘱能否在另一法域被直接执行，仍取决于当地法律。我们通常建议采用双遗嘱结构，而非依赖单一遗嘱跨境执行。
我在中国有房产，应该写进澳洲遗嘱里吗？
通常不建议。境外不动产多须依当地法律处理，写入澳洲遗嘱可能引发条款冲突或延误认证。更稳妥的做法，是为境外资产单独立遗嘱，并与澳洲遗嘱互不撤销、彼此对齐。
执行人或受益人在海外，会有问题吗？
可以安排，但需额外考虑跨境送达、身份认证与资金汇出等程序。我们会在起草阶段一并规划，尽量减少日后执行时的阻力。
